New Delhi's Takedown Notice for Offline Messaging App Tests Open Source Limits
A government order targeting Bitchat's GitHub repositories has sparked debate over whether authorities can remove software based on architecture alone, not content.

A Three-Hour Ultimatum
On a Friday afternoon in late July, Jack Dorsey shared a document on X that caught the attention of digital rights advocates across Asia. The notice, bearing the seal of India's Ministry of Home Affairs, gave GitHub three hours to restrict access to three repositories hosting code for Bitchat, an offline Bluetooth-powered messaging application. The urgency was striking, but the legal rationale was even more unusual: authorities were not pointing to illegal content within the repositories, but to the app's fundamental design.
The document argued that Bitchat's decentralized, anonymous architecture posed a threat because it could enable communication during internet shutdowns and resist lawful interception. For lawyers and technologists tracking government approaches to internet control in South and Southeast Asia, the notice represented something unfamiliar. Rather than targeting what users said or shared through the platform, authorities were going after how the software itself worked.
The Protest Context
The timing was not coincidental. For weeks, student-led demonstrations had been building in New Delhi over allegations of examination paper leaks. The movement, which participants dubbed "cockroach" after the resilience of the insect, brought thousands of young people into the streets demanding the resignation of Education Minister Dharmendra Pradhan. Authorities responded with marching restrictions near parliament and periodic internet service suspensions in affected areas.
Local reporting indicated that some protesters turned to offline messaging tools after losing connectivity. Bitchat and Briar, both designed to function without internet infrastructure by routing messages through Bluetooth mesh networks, saw downloads spike. Data from Sensor Tower shows that India accounted for roughly 85% of Bitchat's global downloads between July 17 and July 23, a dramatic shift from about 1% in the preceding month. The app was downloaded more than 91,000 times in India over those five days, with a thirty-two-fold jump on July 19 alone. Daily active users in the country peaked above 330,000 on Thursday, the highest figure Bitchat has recorded in India.

A Legal Puzzle
The notice, dated July 23 and issued by the Indian Cybercrime Coordination Centre operating under the Home Ministry, cited Bitchat's ability to let users communicate "even during network restrictions" and "internet shutdowns." It claimed the app could "circumvent lawful restrictions" while hampering "lawful interception, attribution, and traceability."
Mishi Choudhary, founder of SFLC.in, a digital rights legal advocacy organization, told reporters the document resembled the format of recent government takedown requests but relied on legal provisions that do not clearly authorize removing an entire software project based on its architecture. Before 2021, Indian authorities typically invoked Section 69A of the IT Act and the 2009 Blocking Rules when seeking nationwide content removal. Those mechanisms were designed to target specific posts, accounts, or pages containing illegal material.
This notice was different. It did not identify particular messages, posts, or even repositories containing unlawful content. Instead, it objected to the software's capacity to function outside centralized control. The Internet Freedom Foundation, a New Delhi-based advocacy group, pointed out the logical gap: deleting a repository does not remove the application from devices that already have it installed, and mesh networks continue to operate without servers. What the takedown would accomplish, the group argued, is preventing public scrutiny of the underlying code.
Targeting Open Source Development
Raman Chima, global program director at the Association for Progressive Communications, noted that the apparent notice went beyond the messaging service itself by seeking to remove its open source code from GitHub. He characterized the move as an attempt to suppress a category of software development, not just a specific service provider. The implications for open source communities are significant. If authorities can compel platforms to remove repositories based on how software is designed rather than what users do with it, the boundary around permissible software development contracts sharply.
GitHub did not confirm receiving the document. As of Friday, the repositories remained accessible from India. The company shared a link to its public repository of government takedown requests, which contained no recent entries related to Bitchat. Rose Coogan, GitHub's principal online safety counsel, stated in an email that when the company receives a complete government takedown request, it notifies affected account owners and gives them an opportunity to appeal. Every government takedown the platform acts on is published publicly.
The Shutdown Dilemma
Namrata Maheshwari, senior policy counsel at Access Now, framed the issue as a question of fundamental rights. Blocking an offline messaging platform during internet restrictions risks converting a shutdown into a total communication blackout, she argued. In any democracy, protesters have the right to communicate privately and coordinate peacefully. Mesh networking tools like Bitchat are designed precisely for scenarios where centralized infrastructure is unavailable, whether due to natural disaster, infrastructure failure, or deliberate government action.
India's use of internet shutdowns has been documented extensively. The country leads the world in frequency of network disruptions, with state and local authorities invoking public order provisions to cut connectivity during protests, examinations, and periods of communal tension. The shutdowns typically affect millions of people, disrupting not only protest coordination but also commerce, healthcare communication, and emergency services.
Offline messaging tools challenge the effectiveness of these shutdowns. By relying on Bluetooth rather than cellular or Wi-Fi infrastructure, they create ad hoc networks that function independently of ISPs and telecom operators. For authorities accustomed to controlling information flow through centralized chokepoints, this architecture is a problem. For protesters and residents caught in shutdown zones, it is a lifeline.
What Happens Next
The legal debate over the notice is likely to continue regardless of whether GitHub complies. If the repositories are taken down, the code will persist in mirrors, forks, and local copies. Bitchat is already installed on hundreds of thousands of devices in India. The mesh network does not depend on GitHub to function.
The broader question is whether other governments in the region will adopt similar approaches. Southeast Asian nations have been expanding their legal frameworks for content control over the past five years, often borrowing language and mechanisms from one another. If India's attempt to target software architecture rather than content gains traction, it could set a precedent for other jurisdictions grappling with technologies designed to resist centralized oversight.
For now, the repositories remain online, and the app continues to function. India's Home Ministry did not respond to requests for comment. The notice itself, whether enforceable or not, has already accomplished one thing: it has clarified the tension between government control and decentralized technology in a region where both are on the rise.
